Terms and Conditions for Driver Service
CMS Nepal Pvt. Ltd.
These Terms and Conditions govern the use of temporary and on-demand driver services provided by CMS Nepal Pvt. Ltd. (“Company”, “we”, “us”) to the client (“Client”, “you”).
By proceeding with the booking and clicking “I Agree”, the Client confirms that they have read, understood, and accepted these Terms and Conditions and agrees to be legally bound by them.
1. Scope of Service
1.1 CMS Nepal Pvt. Ltd. provides temporary or on-demand drivers to operate the Client’s vehicle for the duration agreed at the time of booking.
1.2 The service is strictly limited to driving services only. The Company does not provide vehicle maintenance, repair, or mechanical inspection.
1.3 The Client’s vehicle must be legally registered, insured, and in roadworthy condition.
2. Booking and Confirmation
2.1 All bookings are subject to availability of drivers.
2.2 A booking is considered confirmed only after acceptance by the Company and successful initiation of the booking process.
2.3 The Client must provide accurate and complete information including pickup location, destination, service duration, and vehicle details.
2.4 Any incorrect or misleading information may result in cancellation of the service without refund.
3. Service Duration and Overtime
3.1 The service duration shall be as per the confirmed booking.
3.2 Any usage beyond the agreed service time shall be treated as overtime and charged at the applicable overtime rate.
3.3 The Client agrees to pay overtime charges immediately upon completion of service.
4. Payment Terms
4.1 Service charges shall be as displayed on the website at the time of booking.
4.2 Payment must be made in advance or as required by the payment gateway before service commencement.
4.3 Additional charges such as overtime, waiting time, tolls, parking fees, penalties, or fines shall be borne entirely by the Client.
4.4 All payments made are non-refundable except as expressly stated in the cancellation policy.
5. Client Responsibilities
5.1 The Client shall ensure that:

The vehicle is mechanically sound and safe to drive

Valid insurance, registration, and permits are in place
5.2 The Client shall not instruct the driver to:

Violate traffic laws

Drive under unsafe conditions

Engage in illegal activities
5.3 The Client shall be solely responsible for:

Traffic fines, challans, penalties

Legal consequences arising from the use of their vehicle
6. Driver Conduct and Client Behavior
6.1 CMS Nepal Pvt. Ltd. ensures that drivers are verified and trained to the best of its ability.
6.2 The Client must treat the driver with respect and dignity.
6.3 Any abusive behavior, harassment, alcohol or drug influence, or unlawful conduct by the Client shall result in immediate termination of service without refund.
7. Liability and Insurance
7.1 The Client’s vehicle insurance shall be the primary coverage for any accident, damage, or third-party liability.
7.2 CMS Nepal Pvt. Ltd. shall not be liable for:

Any accident, loss, injury, or damage

Mechanical failure of the vehicle

Loss of personal belongings left in the vehicle
7.3 The Company’s liability, if any, shall be limited to the service fee paid for that particular booking.
8. Cancellation Policy
8.1 The Client may cancel the booking within the time limits specified on the website.
8.2 Late cancellations or no-shows may attract a cancellation fee.
8.3 CMS Nepal Pvt. Ltd. reserves the right to cancel a booking due to:

Driver unavailability

Unsafe vehicle condition

Force majeure events
In such cases, refund shall be processed as per Company policy.
9. Termination of Service
9.1 The Company may terminate the service immediately if:

The Client violates these Terms and Conditions

The vehicle is unsafe or illegal

The Client behaves abusively or unlawfully
9.2 In such cases, no refund shall be applicable.
10. Force Majeure
The Company shall not be liable for delay or failure in service due to events beyond its reasonable control, including natural disasters, strikes, accidents, traffic disruptions, or government actions.
11. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Nepal.
Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Nepal.
12. Acceptance of Terms
By clicking “I Agree” and proceeding with payment, the Client confirms that:
